GST Alert: How Recent Court Rulings Affect Your GST Bill In Australia

Recent Court Rulings On Food And GST

The Federal Court and Administrative Appeals Tribunal have made decisions that affect the GST status of some common supermarket products.

These rulings focus on two main product types:

  1. Birds Eye frozen food varieties
  2. Chobani flip yoghurts

These products, which many people buy regularly, are now considered fully taxable for GST purposes.

Understanding GST-Free Food

Usually, most food in Australia is GST-free. This means you don’t pay the 10% GST when you buy it. However, there are exceptions to this rule.

The law says that food is not GST-free if it is:

  • Marketed as a prepared meal
  • A combination of foods where at least one is taxable

These recent court decisions have clarified what these terms mean.

The Birds Eye Frozen Foods Case

The Federal Court looked at several Birds Eye frozen products, including:

  • Steam Fresh Fried Rice
  • Steam Fresh Couscous
  • Steam Fresh Pasta
  • Steam Fresh Quinoa
  • Veggie Rice Risotto
  • Veggie Rice Fried Rice

The court decided these products are “marketed as a prepared meal.” This means they are now taxable and not GST-free.

What "Marketed as a Prepared Meal" Means

The court explained that this term looks at how the seller presents the product, not how people actually use it.

They considered things like:

  • Product labels
  • Packaging
  • How the product is displayed in stores
  • Advertising

The court also said a “prepared meal” doesn’t have to be for a specific mealtime like breakfast or dinner. It’s more about what’s in the food and how it’s presented.

The Chobani Flip Yoghurt Case

The Administrative Appeals Tribunal looked at Chobani Flip Strawberry Shortcake flavoured yoghurt. This product has yoghurt in one part of the container and dry ingredients (like cookie pieces and white chocolate chips) in another part.

The tribunal decided this product is a “combination” of foods, including some that are taxable (like the cookie pieces and chocolate chips). This makes the whole product taxable.

What "Combination" Means?

The tribunal said a combination is when:

  • You can still identify the different foods in the product
  • The taxable food (like cookies or chocolate) is an important part of the product
  • The taxable food hasn’t completely lost its separate identity in the mix

How These Decisions Affect GST On Food?

These court decisions help clarify which foods are taxable.

Here’s a simple table to show some examples:

After these court decisions, the Australian Taxation Office (ATO) released a draft determination. This document explains how they will decide if a food is a “combination” that should be taxable. They say a taxable combination food is one where:

  1. You can identify at least one taxable food in the product
  2. The taxable food is properly combined with the rest of the product
  3. The taxable part is significant enough to affect the character of the whole product
